Sweepstakes Official Rules

1. Sponsor

All promotions are sponsored by Smith Hair Salon, LLC (“Sponsor”), located at 41653 Margarita Rd, Ste 102, Temecula, CA 92591. Promotions are not sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, Google, or any other social media or technology platform (“Platforms”). Any questions, comments, or complaints about a promotion must be directed to Sponsor at Contact@smithhairsalon.com, not to the Platforms.

2. Eligibility

Open to legal residents of the State of California who are 18 years of age or older at the time of entry. Employees, owners, officers, and contractors of Smith Hair Salon, LLC, and their immediate family members and members of the same household, are not eligible to win. Void where prohibited.

3. Agreement to Rules

By entering, each entrant agrees to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all matters relating to the promotion.

4. Promotion Period

Each promotion runs during the dates published with that promotion (the “Promotion Period”). Entries submitted before or after the Promotion Period will not be eligible. Sponsor’s designated timekeeping device is the official timekeeper for the promotion.

5. How to Enter

The primary entry method for each promotion is described in the announcement published with that promotion.

Free alternate method of entry (no purchase and no social media required). To enter without a purchase or a social media account, mail a postcard with your full name, email address, and phone number to: Smith Hair Salon Sweepstakes Entry, 41653 Margarita Rd, Ste 102, Temecula, CA 92591. Mail-in entries must be postmarked within the Promotion Period and received within five (5) days after it ends. Each mailed entry must be handwritten and mailed separately.

Limit one (1) entry per person per promotion unless the promotion announcement states otherwise. Entries that are incomplete, illegible, or that do not comply with these Rules are void. If an entry includes a photo, video, or other content, you represent that the content is your own original work, that you own or control all rights to it, and that it does not infringe the rights of any other person and does not include anyone who has not consented to appear.

6. Prizes and Odds

The prize or prizes and the approximate retail value (ARV) for each promotion are stated in the announcement published with that promotion. The odds of winning depend on the number of eligible entries received. No substitution, transfer, or cash equivalent of a prize is permitted, except that Sponsor may substitute a prize of equal or greater value. Any prize detail not specified in these Rules or in the promotion announcement is determined by Sponsor in its sole discretion.

7. Winner Selection and Notification

The winner or winners will be selected in a random drawing from all eligible entries received during the Promotion Period, on or about the drawing date published with that promotion. The winner will be notified by direct message, email, or phone using the contact information associated with the entry, within five (5) days of the drawing. If a winner cannot be contacted, does not respond within three (3) days of notification, is found to be ineligible, or fails to complete any required document, the prize may be forfeited and an alternate winner may be selected from the remaining eligible entries.

8. Taxes

All federal, state, and local taxes on any prize are the sole responsibility of the winner. For any prize, or total prizes in a calendar year, with a value of $600 or more, the winner may be required to complete and return an IRS Form W-9, and Sponsor may issue an IRS Form 1099.

9. Publicity Release

Except where prohibited by law, participation constitutes the winner’s consent to Sponsor’s use of the winner’s name, likeness, photograph, voice, statements, and city or town of residence for promotional, advertising, and trade purposes in any media, worldwide, without further payment, notice, or consideration.

10. Privacy

Information collected from entrants is used to administer the promotion and is otherwise handled in accordance with Sponsor’s Privacy Policy, available at smithhairsalon.com. By entering, you consent to the collection and use of your information for these purposes.

11. General Conditions and Right to Modify

Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the promotion, or who violates these Rules. Sponsor reserves the right, in its sole discretion, to cancel, suspend, terminate, or modify the promotion if fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the promotion. In that event, Sponsor may select the winner from eligible entries received before the action was taken.

12. Release and Limitation of Liability

By entering, each entrant releases and holds harmless Smith Hair Salon, LLC and its owners, officers, employees, and affiliates, and the Platforms, from any and all liability, claims, or damages arising out of participation in the promotion or the acceptance, use, or misuse of any prize. Sponsor is not responsible for lost, late, misdirected, incomplete, or undelivered entries, or for any technical or human errors that may occur in the administration of the promotion.

13. Disputes and Governing Law

These Rules are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to a promotion shall be resolved exclusively in the state or federal courts located in Riverside County, California, and entrants consent to the personal jurisdiction of those courts.

14. Severability

If any provision of these Rules is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Winner List

To request the name of the winner of a completed promotion, mail a request with a self-addressed, stamped envelope to: Smith Hair Salon Sweepstakes Winner Request, 41653 Margarita Rd, Ste 102, Temecula, CA 92591, or email Contact@smithhairsalon.com, within thirty (30) days after the end of the applicable Promotion Period.
