Terms and Conditions

Welcome to Smith Hair Salon. These Terms and Conditions (“Terms”) govern your use of our website, our mobile application, our online booking and store, and the services we provide, together called the “Services.” By accessing or using the Services, booking an appointment, or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Services.
1. About Us
These Terms are between you and Smith Hair Salon, LLC (“Smith Hair Salon,” “we,” “us,” or “our”), a California limited liability company with its principal location at 41653 Margarita Rd, Ste 102, Temecula, CA 92591, and an additional location at 40404 California Oaks Rd, Suite E, Murrieta, CA 92562. 2. Eligibility
You must be at least 18 years old to use the Services and to agree to these Terms. Services for minors are available only with the consent and, where appropriate, the presence of a parent or legal guardian, who accepts these Terms on the minor’s behalf.
3. Our Services, Consultations, and Results
Smith Hair Salon provides professional hair services, including cutting, color, lightening, styling, treatments, and related services, which you may book online, through our app, or in person. Hair results vary based on your hair’s history, condition, and home care. We cannot guarantee a specific result, particularly for color corrections and lightening. Any price quoted before a service is an estimate and may change after an in-person consultation. We may decline or stop a service when we believe it is not in the best interest of your hair’s health.
4. Appointments, Booking, and Cancellations
You may book through our Platform or by calling the salon. We may require a card on file or a deposit to reserve certain appointments. Please give at least 24 hours’ notice to cancel or reschedule. Late cancellations, no-shows, and significant late arrivals may be subject to a fee or may require rescheduling, as described in our Cancellation and Reschedule Policy. We may cancel or reschedule an appointment for unforeseen circumstances and will notify you as promptly as we can.
5. Health, Allergies, and Patch Testing
Your safety matters to us. You agree to tell your stylist about any allergies, sensitivities, skin or scalp conditions, recent treatments, medications, or pregnancy that could affect your service. For color and chemical services, we recommend an allergy patch test at least 48 hours before your appointment, especially if you have sensitive skin or a history of reactions. To the extent permitted by law, Smith Hair Salon is not responsible for reactions or outcomes that result from conditions or information you did not share with us.
6. Service Satisfaction and Adjustments
We want you to love your hair. If you are not satisfied with a service, please contact us within seven (7) days so we can make it right, which usually means a complimentary adjustment with your stylist. Refunds, when provided, are at our discretion and are handled under our Refund and Returns Policy.
7. Pricing and Payment
Payment is due at the time of service unless we agree otherwise in advance. We accept major credit and debit cards and any other methods shown on our Platform or offered in the salon. Prices are subject to change. You are responsible for any applicable taxes and any gratuity you choose to give.
8. Gift Cards, Memberships, and Products
Gift cards may be purchased online or in the salon. In accordance with California law, our gift cards do not expire, and any remaining balance under ten dollars may be redeemed for cash. Gift cards have no value except as required by law and are not replaced if lost or stolen. Memberships are billed and may be cancelled as described in the membership terms presented at sign up. Retail products may be returned under our Refund and Returns Policy and should be used as directed.
9. Communications and Text Messaging
By providing your phone number, you agree that we may contact you by phone call and text message about your appointments and services, and, where you have opted in, about promotions. Message and data rates may apply, and message frequency varies. You can opt out of text messages at any time by replying STOP, and you can reply HELP for help. Consent to marketing messages is not a condition of purchasing any service or product. You may opt out of marketing emails using the unsubscribe link in any message. We may still send transactional messages, such as appointment confirmations, as needed to provide the Services.
10. Photography and Social Media
We may photograph or record hairstyles and results and use those images to promote Smith Hair Salon, including on social media and our website. If you would prefer that we not use your image, simply let your stylist or the front desk know, and we will respect your request.
11. Intellectual Property
All content on our website and app, including text, graphics, logos, images, and the Smith Hair Salon name and brand, is owned by or licensed to Smith Hair Salon, LLC and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or use our content without our written permission.
12. Acceptable Use of Our Website and App
You agree not to use the Services for any unlawful or unauthorized purpose, to interfere with the security or proper functioning of the Services, to misrepresent your identity, or to access an account that is not yours. We may suspend or restrict access for conduct that violates these Terms.
13. Third-Party Links and Services
Our Platform uses and links to third-party services, including our online booking and store, payment processors, and the Apple and Google app stores. We are not responsible for the content, products, or practices of third parties, and your use of those services may be subject to their own terms and policies.
14. Disclaimers and Limitation of Liability
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent permitted by law. To the extent permitted by law, Smith Hair Salon, LLC and its owners, officers, and employees are not liable for any indirect, incidental, or consequential damages, or for technical issues, outages, or data loss. Except where the law does not allow it, our total liability for any claim relating to a service is limited to the amount you paid for that service. Nothing in these Terms limits any liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Smith Hair Salon, LLC and its owners, officers, and employees from any claims, damages, or expenses arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of another person.
16. Privacy
Our Privacy Policy explains how we collect, use, and protect your information. By using the Services, you agree to the practices described in the Privacy Policy.
17. Changes to These Terms and Termination
We may update these Terms from time to time. When we do, we will post the updated version on this page and change the effective date shown above. Your continued use of the Services after changes take effect means you accept the updated Terms. We may suspend or end access to the Services at any time, without notice, for conduct that violates these Terms or for any other reasonable cause.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Before filing any claim, you agree to first contact us so we can try to resolve the matter informally. Any dispute that cannot be resolved that way shall be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to the jurisdiction of those courts.
19. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the least extent necessary, and the rest will remain in effect. These Terms, together with the policies we reference, are the entire agreement between you and Smith Hair Salon, LLC regarding the Services.
